End User License Agreement

Effective Date: August 2024

This End User License Agreement ("EULA") is a legal agreement between you ("User") and the developer of the Emergency App Ultra ("App"), governing your use of the App. By installing, accessing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, access, or use the App.

1. License Grant
The developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App solely for your personal, non-commercial use in accordance with the terms of this EULA.

2. Ownership and Intellectual Property
The App, including all content, features, and functionality, is the exclusive property of the developer or its licensors. This EULA does not grant you any rights to use the developer’s trademarks, logos, or other proprietary information except as expressly permitted by this EULA. You agree not to reproduce, modify, distribute, or create derivative works based on the App without the developer's express written permission.

3. Restrictions on Use
You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.

  • Rent, lease, lend, sell, redistribute, or sublicense the App.

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.

  • Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party’s use of the App.
     

4. Updates and Modifications
The developer may, at its sole discretion, provide updates, enhancements, or modifications to the App, which may be automatically installed on your device. You agree to receive such updates as part of your continued use of the App. The developer reserves the right to modify or discontinue the App at any time without notice and without liability to you.

5. Termination
This EULA is effective until terminated by either you or the developer. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices. The developer reserves the right to terminate this EULA and your access to the App at any time without notice and without liability.

6. No Warranties
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The developer makes no warranty that the App will meet your requirements, be error-free, or operate without interruption.

7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall the developer or its affiliates, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use the App, even if the developer has been advised of the possibility of such damages.

8. Indemnification
You agree to indemnify, defend, and hold harmless the developer, its affiliates, employees, agents, and licensors from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your breach of this EULA or your use of the App.

9. Governing Law
This EULA shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. All disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in Gurgaon, India.
